Legal Question in Criminal Law in New York

11 year old gets into fight

My 11 year year old grandson got into a fist fight with another 11 year old boy on the block. They have been at odds for a while and the other boy just moved 5 doors away from us last month. The boy's mother is pressing charges. Do we need an attorney? What can happen? I am scared. Can she sue us for money??? We have none!!

Your son may be facingcharges, as well as a potential civil liability on your part as a result of you being the parent of the child involved in the fist fight.

If charges are filed, then this should be taken very seriously. Anytime you get mixed up in the family court system, and you must remember that it is a 'system', it will chew you up.

Never try to navigate 'the system' without a lawyer to help you and the earlier the better. It is possible to head off prosecution.

The other child's parents can make a complaint, but it is the prosecutor who decides to 'file charges'. The filing initiates the criminal action and , because he is 11, the matter will be decided in family Court.

In NYC the prosecutor is not the District Attorney, but rather the NYC Corporate Counsel.
