Legal Question in Criminal Law in New York

my 19 year old son got arrested for a small amount of pot. I was told that because he lives at home I have to pay for his attorney and he was denied a public defender. He has a job but doesn't make enough to hire an attorney or live on his own. Why should I have to pay for his attorney when I can use his as a deduction on my taxes and he can go fight in a war.

I live in NY and just think it is ridiculous that this is what I was told I have to do
