Legal Question in Criminal Law in New York
our 11 year old son damaged someones property
he scratched a 17 year old neighbors
used car, intentionally, but regrets it.
the estimate for the repair is $900. the
parents told me he probably will not get
it repaired, but still want the same
amount of money. they will not settle
for less.?? i feel we are responsible for
the repair only. i am willing to pay the
the body shop for the repair directly or
negotiate with them if they don't want
to repair it. i can get the price down on
the repair because the mechanic is also
a friend of mine. can i insist on this??

Re: our 11 year old son damaged someones property
The owner of the car has the right to choose where and when or even if they will have the repair done, and by whom, so long as the cost of the repair is reasonabale and within the normal range of costs charged to the general public. The damage is $900. Option 2 is to go to court and spend a day or two waiting for a judge to award your neighbors $900 plus costs of bringing suit.
