Legal Question in Criminal Law in New York

16 years ago my now husband took a plea bargain on accusations made by his then stepdaughter that he innappropriately touched her. He took a guilty charge and was placed on probation, went to a sex abusers counseling for 5 years and has since been listed as a level 1 sex offender. The girl is now 30 years old and has stated that she is willing to admit she lied 16 years ago as long as she cannot get in trouble. We have been told by an attorney that it has been too long for them to do anything to her. Our question is, how do we go about getting my husbands name cleared and everything removed from his record?

It would seem that the time limits are all gone for appeals on this issue. New York does not have expungement of criminal records. Talk with an attorney about possibly reopening the case as this is "new" evidence. Your husband needs to actually sit down with an attorney with all the facts and this woman's statement that she lied and get advice.
