Legal Question in Criminal Law in New York

ACD Information

I was recently granted an ACD for posession of marijuana & paraphenelia, and I was given a year. throughout this year, what if i get a summons for something like loitering, being in the park at night, underage drinking? etc. I am just curious, and if i was to be charged with another crime would it be more serious now that I have this present record on my case. is it ever really erased from the police record? your response is greatly appreciated, I need to get my ACD time down so i can get a job or internship, is there anyway to do that??

Re: ACD Information

You've asked a lot of questions.

Q1. Can a violation cause me to be restored to the criminal calendar.

A: Yes. Stay out of the park after dark do not spit on the sidewalk, and don't dawdle much less loiter.

Q2: How will this arrest affect me after the ACOD is done.

A: the ACOD voids the arrest and cannot be used against you in any way. In fact the police are usually ordered to seal their file. THE FBI REFUSES THIS STATE COURT ORDER.

Q3:Can I shorten the time of the ACD?

A: Yes petition (or have your lawyer petition) the court and ask. For good cause the court can reduce the time altought the Prosecution may have to agree.

Good luck.
