Legal Question in Criminal Law in New York

need advice

I was convicted in april of 2006 to a felony for grand larceny and a felony for possession. i got 5 years felony probation and feel like i got screwed. i forged about three thousand dollars in chechsk from my brother and got caught with 84 bags of heroin. the cops were called because of my brother and i fighting, and when they got their i got arresstsed for them seeing the checks and i had the heroin in my pocket which i was charged with after being arressted and put in cuffs. At the time of the alledged crime i was 18 or turned 19 the day after the crime. I feel i got screwed because i was an addict who went to rehab and got sober, it was a family affair, i had no prior arrests ever in my life and feel i shouldve been charged as a youthful offender i tried tog et drug court for a year but the da refused. I wonder if the case was rexamined by another lawyer would i have any good arguements if someone could answer me back asap id appreciate it thank you

First off, you are too old for youthful offender status, you must be under 18 years of age. Second, drug court is at the discretion of the court and in your case, being caught with 84 bags of heroin, you were probably charged with possession with intent to distribute. In most cases that would take it out of the realm of drug court.
