Legal Question in Criminal Law in New York
aggravated harassment
I have been charged with 240.20.01...aggravated harassment 2nd for sending e mails to a co worker...e mails with no content in the body but the screen name i used made implications to an extramarital love affair he had at work. I did this because he was harassing me, although have no concrete proof other than word of mouth.
What are the possible consequences for this misdemeanor...this is my first offense.

A Misdemeanor is a crime. Technically it is punishable by fine and/or imprisonment. As a practical matter however, a first offender is usually treated less severly, depending on any extenuating circumstances with the matter. Most prosecutors will offer your attorney an ACD which is an Adjournment in Contemplation of Dismissal, and a fine and possible an Order of Protection. This becomes part of the plea negotiation between your attorney, the ADA and the judge. Best of Luck.
