Legal Question in Criminal Law in New York
I was given an appearance ticket for unlawful possession of marijuana contrary to the provisions of section 221.05. I had a bag in plain sight with an eighth of a gram.
I've read that the court must produce a lab report to prove that it was actually marijuana and have that report on my court date or the case will be dismissed. Is this true? It is a 100 dollar fine and no criminal record if I plead guilty.

They do not necessarily need a lab report on the first court date. Ask for an ACD when you go to court if this is your first offense..
