Legal Question in Criminal Law in New York

Arrest For Harassment, Perjury, and Obstruction of Justice

My ex-girlfriend has made false accusations that I was/am stalking her and text messaging her. She filed a police report that resulted in my arrest. The DA however ''declined prosecution'' and I was released the following day.

I was not told as to why this case was declined prosecution but I feel that the DA knew it had no evidence and a weak case.

She has made attempts at getting me in trouble with the police before. This is not her first police report against me. Unfortunately our breakup was difficult for her and this is her retaliation.

I must also add that she has been clinically diagnosed mentally disabled with social anxiety disorder and depression. She has been prescribed anti-depression and anti-psychotic medications and has been in psychological therapy since before our relationship.

Can and should I file a complaint with the police for harassment, perjury, and obstruction of justice and can she be arrested for these violations?

YES, she can be arrested for filing false charges, if it is found that this is what occured. I would also seek an order of protection against her.
