Legal Question in Criminal Law in New York

I was arrested back in June 2004. First arrest. Charge was possession of stolen property. Went to court where they asked me to do a classwasnt able to go to the class so I called to tell them and they said they would send me a new court date. Never received that letter ( I KNOW. it was my responsibility to follow up on that and find out when the court date was). this is still an outstanding charge. I do not live in that area anymore. My question is-in NYS-how long do arrests show and outstanding warrants? Is it back 7 years on background checks? I do have to take care of this but in the meantime, I applied for an apartment who said they are doing a criminal background check. I have had them run before and it has only come up once out of maybe twenty run. So, how far can they legally check back? Also, what is your advice in getting this taken care of other than appearing in court. I genuinely want to take care of this and have never been in trouble since then( or before).

You need to resolve this matter now. It requires that you retain counsel and make an appearance ASAP.

There is no limit as to how far back a background check can go. I have seen minor charges show up after ten years. Some minor offenses can be handled without a personal appearance but I would need to know the exact charges and the court where the warrant was issued.

If you failed to comply with the terms of your plea agreement, there is probably an outstanding bench warrant for your arrest. An attorney can have the warrant vacated and request that a more convenient resolution be accepted (such as a fine). For a reasonable fee quote, contact my office at 646-450-3473.
