Legal Question in Criminal Law in New York

I was arrested for cpcs 7th. I was released on 100 desk appearance ticket. Can I show up for court without a lawer? The substance was ambien sleeping pills. This happened in suffolk county n.y. What am I going to be looking at?

You are currently being charged with a misdemeanor. A conviction would have consequences regarding travellig out of the country or with financial aid status as well as other collateral consequences. It is always preferable to have a lawyer , however there is no requirement to have one. There may be defenses relating to a prescription or the validity of the search. You will have an attorney covering you for your first appearance, as a right.

Your income falls above a certain level, which is very low... Then you will not qualify for an attorney appointed by the government after that first appearance.

A charge such as cpcs 7 is something I handle regularly, there are various questions I would want to ask including your citizenship status... Where depending on the answers it may be very important if there is a plea, what charge you would plea to.

Also, depending on the facts I would want to know if there was a legitimate prescription for the medication and if so there may be other defenses, even if for example the prescription was not for you specifically...
