If you are arrested for a crime and given an appearance ticket for the crime, stating the crime in the 3rd degree can it be crossed off and changed to the 2nd degree by the court when you appear?

Yes it can if the elements of the more serious crime are present.
It would be highly recommended to have an experienced lawyer with you defending you and preserving your rights in court. It would also greatly increase the chance of lowering the charges. We have substantial experience handling these types of cases and reasonable fees, however, we would need some more information before making a complete and proper determination.
