Legal Question in Criminal Law in New York

I was arrested for DWI in my driveway when I had been home for over 30 minutes. someone called in my plate saying there was a sick or intoxicated person driving my vehicle. I was outside when cop arrived playing with my son and dog with a beer in my hand. Keys were in the house. I live in NY. Is this even legal. they also gave me a field sobriety check in my driveway before taking me to the station. they never took me jail or took my license. THey actually brought me back home. I did blow though.
