Legal Question in Criminal Law in New York

I was arrested on a misdemeanor charge for shoplifting. It is my first offense. I stole $111 worth of merchandise in Manhattan. Should I get a lawyer? What is the likelihood I will get community service and have it wiped off my record if I stay out of trouble for six months?

You should hire a good criminal defense lawyer because you are charged with a crime. I have had very good success in negotiating an ACD in cases like yours, which results in dismissal after six months - sometimes sooner if there is a compelling reason.

I might add to the end of it some "friendly" advice spoken colloquially: God forbid you DON'T get this ACOD'd, your life will be hell in many areas with even a misd record. You will have to put it down on so many documents such as applications for jobs, where although they can't really discr against you on misd, think about it: 200 applications for one job and some have a criminal record on there. If you lie, they will catch you anyway and today it is inexpensive to check.

If you have kids and a spouse, or are planning to, you never know how ugly things can get in a Family Law battle-I do matrimonials as well as foreclosure defense, which often intersect with some criminal law related to animal law. As Billy Joel wrote in Brenda and Eddie: "they started to fight when the money got tight and they just didn't count on the tears...". Except Brenda and Eddie got a "nice" divorce and even when people come in stating it is an uncontested divorce, when I start asking questions about x and y, it changes. You just never know how a conservative judge will look at your record and perhaps form an opinion about you, albeit for a tiny thing.

So, in short-lots of us make mistakes but get a lawyer and make this thing go away, and never get in trouble again. This is the era of computers and there are eyes everywhere watching us.
