Legal Question in Criminal Law in New York

I have been arrested for Petit Larceny for borrowing a girls cell phone and sending a pic on her phone to my email before returning her phone to her. She saw that it was sent and she didnt give me permission and went to the campus police who forwarded the case to the town and I got an appearence ticket for Petit Larceny. I have a background of 'Falsely reporting an incident' but was put on aggressive rehab and it has ends this january. I recently have been charged with petit larceny and am curious as to if I am going to see jail time for this incidence given that I do have a slight background? I have never been in trouble for any larceny or anything and I am a full time student and full time employee at age 21. What is the likliness of me seeing jail time? If not, what will I be likely to see as a punishment?

I don't believe you would do jail time. However, it would help to know where the court is located. Also, it appears from your post that she gave you permission to use the phone. There is an argument regarding the scope of that permisiion.
