240.26 is a violation and not a crime. You are however punishable by up to 15 days jail and/or a fine of up to $250.

Although 240.26 is classified as a violation and you can get up to 15 days in jail and up to a $250 fine, you will probably be offered an ACD,meaning a delayed dismissal provided you stay out of troube for six month. At that time the case will be dismissed.
