Arrested using a senior citizen metrocard

I am a 19 yrs old and was arrested yesterday. I was brought to a precinct that only deals with MTA violations. Here I was photographed and finger printed. After which, they gave me a DAT. This is my first arrest and I have no priors. My problem is, I'm going to be abroad during the court day. I was wondering if I can postpone the DAT for 2 months until I come back. If so, do i need a lawyer to do it? I'm also worried about it affecting my application to be naturalized.

With your non appearance possibility and your immigration status, it is necessary to retain a competent criminal defense attorney. That attorney should be able to with proper documentation either advance your case or pospone it without a warrant for your arrest being issued. You should speak with an attorney. You may very well be facing a misdemeanor charge that carries a possible penalty of up to a year in jail. Given this fact along with your immigration concerns it is highly recommended you consult with an attorney. An attorney may be able to resolve this in a way that does not result in lasting consequences to you. Also, the attorney may be able to get your case advanced, so that it can be resolved prior to your trip. HIRE AN ATTORNEY, if you do not show up in court on the date set, and you do not have an attorney appear for you there will be a warrant issued for your arrest... you will without question need to hire someone, as this will be heard before a criminal court judge and they will not hesitate to issue such a warrant.

I am a former Assistant District Attorney and I recommend you retain a lawyer. Your court date can get moved up or pushed back with proof that you are away. As for the charge, it can be resolved without affecting your immigration status. Feel free to contact me.
