Legal Question in Criminal Law in New York
I was arrested in upstate New York in 2004 for 30 lbs of marijuana, a Class C felony. I have since been living in Canada without going to court. If I choose to go back now in 2011, will I be charged, or is there a statute of limitations such as Article 30.10?

You must be the subject of a warrant. As such, there is no limitations period. So, if stopped by the police or at the border you will be arrested.

Even if you were not arrested, any statute of limitations is tolled when you are out of the state.
