Legal Question in Criminal Law in New York
I was arrested 5 years ago for a traffic related matter and my lawyer was able to get me off with an ACD (No Crimical offense) and some community work.
Now I was arrested again for Petit Larceny ($125 worth of shoplifting) with a Class-A misdemeanor....Can my Attorney ask for another ACD this time around or not?? What are the chances of getting one?? Thanks for your time

Yes, he can request an acd on the new matter. Whether he gets one will depend on the jurisdiction you are in, the strength of the People's case and the orig charge five years ago. If it was a DWI less of a chance than if it was a 512 violation
