Legal Question in Criminal Law in New York
I was assaulted by my mother boyfriend while he was intoxicated, when the police arrived I wasn't able to press charges because I didn't have any physical evidence...The cops just laughed it off. Later that day my eye was killing me, when I woke up my eye was just about swollen shut. I went to be seen and I was sent to the E.R...The social worker called the police and the guy was arrested. Our court date is tomorrow and I still cant see out of my right eye (nothings clear). I missed atleast 5 days of work, school (I failed a course due to my absence, which leaves a bill), and my medical bills (I have medicaid). The guy only receives Social Security as a main source of income, will i be compensated for pain & suffering or punitive damages?

Not in criminal court. You would need to sue him civilly.
