Legal Question in Criminal Law in New York

Assaulted ~ resulted in broken nose

I was sucker punched in the face by a drunken female customer at a gentlemens club. The incident was unprovoked and she was charged with what I assume is misdemeanor assault.

My injuries are a nasal fracture and deviation which will require a re break and re set to hopefully repair it to its original from.

Is it likely that I can collect on a civil suit (individual) or a negligence suit (business) ?

Assuming it was an unprovoked attack, you can certainly sue the assaulter - the question is does she have assets to collect from? As for the club, that is a very fact specific issue and I would need more information. Please feel free to contact me. There is a one year statute of limitations for assault and 3 years for negligence. The statute of limitations against the assaulter is tolled while the criminal case in open. The above is for informational purposes only and not meant as legal advice as there is no attorney-client relationship at this time.
