Legal Question in Criminal Law in New York

Assualt

I was involved in a fight where i (with no real force) hit a person in the face twice and then after that the person attacked a colored man used racial slurs and attacked him. The colored man in defense hit him back. After their altercation The person left and it was later found out he had a broken jaw. On his police report it stated that i was the only one who hit the person. As of right now no one knows who really broke his jaw. Currently I am waiting to be arraigned on misdemeanor assualt charges. I just want to know what is the chance the charges can be raised to a felony at the arraignment and how should i go about clearing my name? I also have no prior record, a 3.8 college GPA, graduated in the 5% percentile of my highschool class, I am very involved in the community, and I have various written letters of recommendation citing my exceptional character. How much of a factor will that weigh in determining a plea bargain if need be?

Generally, what happens is that while the information you gave may be beneficial to you, as far as your GPA and no previous recors, it will playa relatively minor role in your case until the time of trial.

Usually, where there has been serious physical injury the DA�s tend to push for the higher charges but that may not necessarily be true in your case, and a good attorney can very easily ensure that the situation does not escalate to the point of charges being raised by some intervention and explication.
