Legal Question in Criminal Law in New York

Need Assurance and Help

My boyfriend got into a car with friends. Cops stop car and asked for license and registration, it was given and ok. Other than cops giving info back and ending it they pulled them out one by one and arrested them. Isn't that an illegal search. No probical cause. Drugs were found and three out of the four is blaming it on my boyfriend. He has no priors. Others have drug priors and was released first day of court on ROR. What's wrong with this situation? I don't understand how they got released and he didn't.

Re: Need Assurance and Help

This is a very erious matter.

I don't have all of the facts, but it sounds like the police made a 'traffic stop' (legal) and decided that there were illegal drugs present. (legal). They then decided to arrest everyone in the car for possession (legal).

Here a big problem occurred for your boyfriend. The others seemed to have told the police that they got the drugs from your boyfriend. (It is legal, but perhaps not good judgment for the police to believe them).

So what has happened is that they were charged with possession (not a huge crime) and your boyfriend charged with distribution (a very big crime that is prosecuted aggrssively and harshly).

That means: they had low or no bail amounts and so were released. He, charged with the more serious crime of distribution, had a very high bail amount.

Were these three people friends of your boyfriend - obviously not!

He needs a competant and professional attorney to stay out of jail for a period of years.

This is a very trying time for both him and you. You are welcome to ask me any follow-up questions.
