Attempted Murder

My son was charged with attempted murder, there was no weapon recovered. the only eye witness is the victims girl friend and a neighbor. His freinds say it was not him that someone else who left the seen of the crime did it. We also have several witnesses but have not yet been to court to set a trial date. My son refuses to plea bargan he feels that he can prove his inocence. My question is can attempted murder still be the charge if the victim is doing better? Also can it be proven without a weapon?

The answer to both questions is yes. In your son's best interests I hope you have a good criminal defense attorney and sufficient resources to get a private investigator to help locate the real perpetrator.
