Legal Question in Criminal Law in New York

Bad Check

I had a $2,100.00 insufficient check bounce around six months ago in New York State. I was out of the State for most of the past six months and did not receive paperwork or documentation commanding my appearance in front of a city judge, which eventually resulting in a warrant out for my arrest.

I was arrested last week and taken to the city where the complaint was filled, where I posted bail. I have an arraignment scheduled for Tuesday, my questions are;

1). I assume I should plead not guilty so I hope for a plead deal from the Assistant District Attorneys.

2). Realistically how much trouble can I be in here? In New York this is considered a Class B Misdemeanor which is punishable with up to three months in jail. How likely is it that I will serve any time in jail?

For starters, I would not go to court on a misdemeanor without a criminal defense attorney.

To answer you question, Yes plead not guilty and get a lawyer who will be able to get you a better deal than anybody else including yourself.

Other charges may also lie depending on the facts. You are not (on a first arrest likely to get a lot of jail, but if the court is not impressed with your explainations he could give you 90 days or 60 and probation.

As I have said, Your best shot at a good ending is to hire a good and competant attorney.
