Legal Question in Criminal Law in New York

Bad Check for Rent in NYC

I rented without a lease a room form a landlord in in liue of paying hotel bills as I lived in Texas but worked in NYC much of the time.

The overdraft insurance for my NY checking account on which a deposit and the final rent check were drawn subsequently bounced.I received notice in mid October from my bank of this.I sent two letters to the landlord stating I would take care of the checks plus any fees incurred and interest if that was her wish once I had a new job and had the money.I received no response until the morning of January 1 when she called and informed me she took the checks to the police and informed them that the checks in question were drawn from a closed account. This account was never closed and in fact remains open. I have no criminal record and cannot afford to drive or fly to NYC to take care of the matter. I hope to have a job soon where payback of the checks won't be a problem.

Will I be arrested in Texas? Can I negotiate from Texas?

Specifically, how could an attorney help me and what would the charge be? I have no criminal record , not even traffic tickets. Please advise. Thank you!!

Re: Bad Check for Rent in NYC

It is highly unlikely that the NYPD would seek to extradite you from Texas on a bad check charge. However, you really should pay the landlord to be done with it. A NY lawyer could intervene with the police to see if they are going to do anything. It is possible that the Police took a report to appease the landlord and then closed the case out as belonging in civil court not criminal court.
