Legal Question in Criminal Law in New York
Bail Forfeiture
I bailed someone out of jail and they scheduled to appear in court for the second time in January 2008. The date was changed to early December without notifcation therefore the defendant did not appear. I received a notice of forfeiture 12/19/07. How can I get my bail back? Can I get my bail back?

Re: Bail Forfeiture
The simple answer is, it's possible. The request must be made in writing to the court with advance notice given to the prosecution, and made within one year of the date of forfeiture.
