Legal Question in Criminal Law in New York
got beat up
When me and my friends were drinking. one got angry and beat me in the right eye. eye swelled up so bad for 2 weeks. I didn't see a doctor yet. but my uncle who is a doctor tells me that the little bone under my eye might be broken and the eyeball went in a bit. It's been a month and half since the incident. Now my eye is having a hard time focus. so seeing a doctor and get it CT scanned soon. I'll be asking this guy who did it to me money. What are my chances?
It's been a while since it happened. Could it be a problem?
I'll have to wait to see the result of CT scan, but doctor says that ''it might take at least 2weeks to get surgery and recovered. and since it's about an eye, there's many possibility it could go wrong in the future.''
The guy hit me once in the eye and I didn't hit him back
Didn't call the police since I knew the guy and was going to let it go, but now I can't. because of my eye.
How much money should I ask him to pay?
What is the proper process I should go through?

You can try to file a police report at this point if you would like. The delay in report will make the case more difficult, but if you have other witnesses you will be able to explain the delay. If your just looking for money as a result of your injuries then you should speak with a personal injury attorney. It seems like you are seeking monetary compensation for your injury and not for this person to be arrested and charged with a crime. Criminal charges will be very hard to get filed because of the delay in reporting. Civil action will get harder the longer you delay contacting an attorney. Basically by the time you finish reading this answer, you should be seeking an attorney through whatever means you choose (family/friend referral is usually a place to start).
