Legal Question in Criminal Law in New York
please help
well my boyfreind who has never got in trouble before got into a fight started by the other party Hitting my boyfriend in NYC. His freinds defended him by jumping in and hate to say it like this but won the fight. A man in the other party is now pressing charges, and my boyfreind is not charged with a gang felony asault, becuase the guy who got hurt the most said he was alone which was not true at all. Now the DA is saying they might face something like 10 years!. Is this a possible cenario and what can we do to aviod doing anythime? My boyfriend is also a full-time Juior at the SUNY Oneonta and is trying to further his life with a degree in Finance. Please help we need advice and can not afford a good lawyer nad the court appointed one is no help!

1. Regarding the facts of the case, it seems that your boyfriend has a number of witnesses to the event. In addition, it seems that these witnesses can show that the complainant (victim) has not been truthful with the police or district attorney.
This is very good and can form the backbone of a successful defense.
It sounds like your witnesses and the complainant/victim have very different stories. That is very good for the defense.
