Legal Question in Criminal Law in New York

My boyfriend was arrested and put in jail for a Domestic Violence felony. He is a disorganized scizoprenaic and was not taking medication. Now that he is in jail he taking them and doing a lot better. There is a no contact order in place by the judge because the state had took over. I want it modified because he has no where to go after jail and I need help with bills and rent or I will lose my apartment. Also I want to make sure my boyfriend continues taking meds and going to appointments. My question is will the judge modify my order of protection to a no offensive order?

It might be hard to get this modified, but you can give it a try. The judge may take into account the fact that your boyfriend is now better on medication. However, they may also think that your boyfriend will go off medication after he gets out of jail. You might ask an attorney to help you request the modification.
