Legal Question in Criminal Law in New York
My boyfriend was commuted of a felony, he was supposed to go to jail, but since he has a clean record they said that he didn't have to, instead had him sign a agreement saying he wouldn't talk to the people involved. One of those people were me. So what i'm asking is how do i get this dropped so i can see my boyfriend?

An application must be made by a lawyer defending either you or him to modify the order of protection before the judge issuing the order of protection in question. Upon hearing sufficient and good cause, the judge may modify. However, the judge will rely heavily on the prosecutor. So the lawyer seeking this change should first consult and request the modification from the DA. If the DA agrees, that will help the lawyer persuade the court.
