Legal Question in Criminal Law in New York

boyfriend

i had a domestic violence report written up for my current boyfriend, this lead to a warrant. i did it out of total anger, and i regret it 100 percent- were together and very happy. the report is pretty much a lie, but i was wondering how it works out? I was told i should go with him to currender with lawyer, and he should ask for a non jury trial and then if i dont show up on that day, the case is dropped. please help

Re: boyfriend

You may want to retain your own attorney to advise you. There is a possibility that if you tell the police you lied they may turn around and arrest you, especially if you signed sworn statements. The prosecutor is unlikely to dismiss the case just because you changed your story, since this is very common in domestic violence cases. Furthermore, depending on the severity of the charges the prosecutor may be able to have you arrested as a material witness and brought into court. Therefore, not showing up in court may not be in your best interest. You should consult with an attorney (other than your boyfriend's attorney) about the best way to accomplish your goals.
