Legal Question in Criminal Law in New York

My brother has been arrested for having had an adult chat room. The police had gone undercover as a minor on this chat room and had made a meeting with him. My brother went to the place, but waited to see the girl before doing anything. He was then arrested for solicitating sex from a minor. But this is not true. Was this an entrapment? Can he get probation even when being an immigrant?

I need to know the details of the communications between him and the girl he went to meet. If her age was represented as below 18 and they discussed specific plans for sex, he has big problems.
