My little brother was arrested on Friday when he and two of his friends attempted to break into someones home. He never made into the house, and fled when the owner of the home spotted him. He was caught a little while later and charged with 2nd degree attempted burglery. Is he looking at any jail time, he is 19 and had no prior felonies.

A competent criminal defense attorney ,if what you are saying accurately portrays the facts, might be able to plea bargain the charges to Criminal Trespass. This plea might preclude any jail time.
