Legal Question in Criminal Law in New York
What can be done?
My brother who is 17 is currently incarsoated and has not been sentenced since jan. 23, 06. His charges are two counts of robbery in the second degree. The victim in the case stated that the two men involved were 5'9 and 5'10, my brother is 6'5. he was also placed in a few lineups and was not picked out there are two other boys involved trying to implicate him in the situation. My brother amitted to using the cell phone but that was after police questioned him knowing he was repersented by a lawyer and the lawyer told them not to.
My question to you, why have they not released him and what are some steps that can be taken to clear him.

If he is in jail on the basis of an arrest, then he has a right to a bail application. This is typically done at the arraignment.
