Legal Question in Criminal Law in New York
My brother was recently arrested for having perscription meds in his car. They were in a bottle with his name. So i have two questions. 1. Are they able to book him even if he had his name on the bottle? and he told the Cops to go F*** Themselves and Now there holding his BMW, Are they able to keep his car if he talked bad?

If he has a valid prescription for the meds, that should be a defense to the charge. They are probably holding his car under the civil forfeiture statute. They cannot hold it simply for "talking bad"
