Burglary

Can you be charge twice for one crime commited?

If you did 3yrs and you was sentence for 10yrs, can the 3yrs that you did before sentence be taken off the 10yrs they give you?

YOu cannot be CONVICTED twice for the same crime unless your original conviction is overturned for some reason and the state seeks a new trial. If you did 3 years in jail waiting to be sentenced, the three years will be credited to the final ten year sentence as "time served". Please call me if you wish to discuss this further. Time spent in jail while a charge is pending is credited to the defendant on any sentence imposed on the charge age at sentencing.
