Legal Question in Criminal Law in New York

Car Insurance and possible fraud.

A person who lives in New York and Woks in New York wants to insure their car in Florida. They are using a family member's adress and claiming it is their own in order to gain insurence as a Florida resident. Is this illegal and who can get in trouble?

This is called ' insurance fraud'. It is a felony. However, it is rarely prosecuted by the DA.

If discovered, the most probable outcome is the insurance company will require all of the back-charges that were avoided by the address be paid. However, you can avoid this by merely finding a new insurance company.

If you do this with more than one insurance company, the DA may take an interest.

Lots of people do this, but that doesn't make it right. But again, my experience is that no one has gone to jail for this in the state of NY.
