Legal Question in Criminal Law in New York
Can a case be moved to circuit court?
I would like to is it possible for a case to be moved from district court to circuit court because there is supposedly an audio/video tape of a person conducting a drug sale and on his first court appearance an officer testifies against him who was not present @ the time but becuase he says he has this so called evidence the judge decided to move the case to ciruit court? Without this evidence being presented. Is this legal? if not can this decision be appealed automatically?

The decisions may be appealed immediately by presenting the issue a judge of a higher Court, i would consider hiring an experienced attorney to help assist you with this matter, in cases involving federal criminal issues it is highly important to have private counsel to negotiate with the AUSA's office on your behlaf, it makes a major difference...
