Legal Question in Criminal Law in New York

caught shoplifting.

I was caught shoplifting with friends. No idea if they took anything. Confronted outside of store. We both denied the charge, and kept walking. Entered another store, LP grabbed my shirt/bra to detain me. I gave myself up, friends ran. Got arrested, charges are being pressed. Total cost of items stolen? $13.50

It was a stupid mistake, I'm a college sophomore at a state school with a 3.4 GPA, heavily involved in my community (received scholarship for it!) my mother's church, etc. I've never done anything like this in my life, and I am so upset.

I cannot, CANNOT afford a lawyer. I am 19 and have $700 to my name. Involving my parents is not an option, they would be heartbroken.

I talked to a lawyer who will be giving me a free consultation via phone in the morning. Can I go this case alone/with a court-appointed lawyer? I really can't get any more money!

Re: caught shoplifting.

You will be compounding your initial mistake by not getting an attorney to assist you. You may be eligible for a court-appointed attorney. If so, take advantage of that.

If you are not eligible for a court appointed attorney, you should consider telling your parents so that you can hire an attorney. This is a relatively minor charge but a conviction is permanent and may affect your future.

As hard as it may be to tell your parents, you should do it so that you can hire a good attorney. This is your best chance of minimizing the damage of this incident.

Re: caught shoplifting.

yes, the court will appoint a lawyer for you so that shouldn't be an issue. yes, you can represent yourself but i wouldn't, even on a case such as this. you were stupid to steal, so don't be stupid now -- you don't want a conviction on your record, given that you are going to college and will be looking for a job soon. a lawyer should be able to work something out on your behalf, given your history. best of luck.
