Legal Question in Criminal Law in New York
i am charged with assault 3
Hello,
This has been really stressful..I had broken up a fight between two girls about 7 months ago. I am a female. The girl went to the hospital that night and made a report indicating I was involved more than I was. I recently (in september) 6 months after the incident appeared in court and they told me that she doesn't know what she wants to do yet. She had a order of protection that I signed, 6months later, along with the girl that was the one in the fight I broke up.
The detective originally told me that I would be dismissed because I had assault 3 meaning I didn't have any means to hurt the girl, and the other girl had a more severe assault 1. I found out we both have assault 3. My attorney told me that this is definately a case and that I could go to trial. Please!!! Someone explain this to me and any possible ways I could handle this situation. There was a witness on the scene who saw I just broke up the fight as well. Thanks.

From the info you provide, it looks to me like you will have to go to trial and fight this case. You must make sure your witness will appear at the trial for you.
