can you be charged with crimnal possion of marijana 1 first deree even though at the time they arrested you with nothing in your possion

There are many circumstances you can be charged. If your apartment was searched pursuant to a search warrant when you were not home and drugs were found, you can be charged with possession. I would need more information.
