Legal Question in Criminal Law in New York
I'd like to know if someone charged with first or second degree murder in New York State can be free on bail? This is for a novel, I'm writying.

Bail, by the constitutions of both New York State and the United States is guaranteed and is only to be used to insure your return to court. That being said, yes inf a judge feels that the situation warrants, bail can be set. In the overwhelming majority of cases, a judge will not set bail on a capital crime or bail will be very high.
