Legal Question in Criminal Law in New York
Charged with identity theft
I am asking this on behalf of my sister in which she does not have access to the internet. She was just recently charged (or has an apearence in court) with ''Identity Theft''. I'm unsure of what the exact charge is but it involved $3000 of false credit card charges.
She was release without needing bail. The card belonged to her ex-husband. What I need to know is what she could be facing and how good would it do to pay this debt off prior to any plea or court date.
She has no prior record or anything involving the law. Is she looking at jail time, probabtion, fines, ect.

I know that you might not be satisfied, but the answer to all of your questions is "it depends."
The penalty she could be facing depends both upon the charge and age. Whether she should pay the bill also depends. On the one hand, if she paid it, one might assume that she is guilty of something. On the other hand, paying it might get her a favorable resolution of the case. What she is realistically looking at depends on the jurisdiction - New Jersey? Manhattan? Nassau? etc. It also depends on the DA assigned to the case and the specifics of the offense.
