Legal Question in Criminal Law in New York
charged with misdemeanor
Please help me. I'm inquiring for myson. 3 days ago he was stopped by the police because they said he was swerving across the lines. He had just left work. He works 11-7:30am shift. He was asked to step out of his car; and was placed into the police cruiser. They asked him if they could search his car. he said yes. They told him they found 3 empty herion packets in the door of his car. He was arrested and charged with a misdemeanor.My son has never been arrested before. He has no police record. He has just finished school and passed the test for his long distance truck driver license. We don't know what to do. This has messed up his life. He doesn't use drugs . He begged them to do a drug test on him but they didn't. H is suppose to go to court on May 25th. What should we do so that my son doesn't be charged falsely. He has ab excellenty work history. He was employed by Ford Motors until his plant was closed down. That is the reason he obtained his professional drivers license. Please help us.

Your son may have possible legal defenses and/or there will be a possibility of a plea bargain. Also there will be a lab report available in court on the next date,these possibilities if correctly explored will be helpful to your son. Your son needs to retain a qualified criminal defense attorney. While he may have defenses, one of the pressing issues would be to how this case could impact his license status. Did this happen in New York or New Jersey. If in New York, what County? While the situation sounds scary, a good criminal defense lawyer can probably resolve it so your son does not get hurt. The bottom line is that if your son is a first offender with this charge he can apply to be treated as such even if efforts to otherwise dismiss his case fail.
