Legal Question in Criminal Law in New York
I was charged with a misdemeanor petit larceny for theft of 3 pieces of jewelery. If the plaintiff recovered all 3 pieces of jewelery should I still be responsible to reimburse the plaintiff for the jewelery that was recovered?

The answer is maybe. How was it recovered? Was the victim (not plaintiff because this is a criminal action), made completely whole because he recovered the money from his insurance company? If so, you would need to reimburse the insurance company. Or did the victim have to hire an investigator or someone else to track down the stolen items? If so, you could be held responsible for those costs. Did the plaintiff have to buy them back from a pawnshop, for example? In other words, if the victim incurred any out of pocket costs in recouping the stolen merchandise, the DA has the discretion to request that, as a part of a plea bargain, you reimburse the victim
