Legal Question in Criminal Law in New York
i was charged with petty larceny back in december 2010.
my next court date is august 15, 2011
however, because it is summer time, my family is going on vacation out of the country to the philippines and i was wondering if i would be allowed to leave the country for a short period of time. i will be back before august 15. but are there certain rules in order for me to leave the country while on trial.

if you were arrested in 12/10 and your court date is 8/15/11, then you are already represented by counsel and that is who you address this question to. Usually, if you are released on your own recognizance, there are little or no restrictions on your ability to travel. However, if you are not a US citizen, then you may be detained or worse based on the fact that larceny cases are deemd crimes of moral turpitude for immigration purposes. That is why it is best to speak to your current attorney who is familiar with ALL the facts of your case.
