Legal Question in Criminal Law in New York
charges: 130.25 FE
My brother (39 yrs.) was accused by his wife to sexually abuse his step daughter (16 yrs). Both now are in jail for the same charges. This occurred on 8/1/08 while I was on vacation. I have read several emails that we should contact a lawyer immediately. His next court appearance is on 8/22/08. I want to contact his public lawyer in order to find out all charges. What are my rights, can this lawyer give me copies, advise me? I don't know what has been said. Please help!

Please contact me ASAP, monday morning would be ideal... give me the basic info on your brother and my office will do a search for you at no charge on this matter...
you should consider hiring an attorney ASAP and not permitting the public defenders office to handle such a matter, as in all honesty there could be a major prison sentence potentially attached to such a charge.
generally, you will not be turned over any copies of documents or the like by his attorney without his direct and specific release, and even then it is usually VERY difficult to reach and have actual conversations with public defenders due to their large cae load and the fact that they simply can not be expected to remember all details on a vast number of cases...
i would consider IMEMDIATELY hiring an attorney. Our office is highly experienced in handling these types of matters and we regularly handle major criminal prosecutions, it is our main area of focus.

Your brother's lawyer is not allowed to give you any info on the case or your brother UNLESS your brother specifically gives the lawyer authorization to do that.
You can find out info about the charges online; in NY, the site is E-courts, or the NY State Unified Court System website.
