civil lawsuit

is there a time limit in which to bring civil suit, was found not guilty in criminal ct--malicious procecution w/ nypd and large corp.---what questions do i ask my lawyer in regards to fee (1/3 of decision ) do i sign contract---should i use high profile lawyer or independant lawyer who handeled trial who knows all details

There is a one year statute of limitations to file a civil lawsuit for malicious prosecution which runs from the date the prosecution ends (as oppossed to one year for false arrest which runs from the date of the arrest). If the City of New York is a defendant, you have to file a Notice of Claim within 90 days of the end of the prosecution.

As for what lawyer to use, you should use one that you are comfortable with. A high profile lawyer may not get you a better result than any other lawyer and may not be around when you need him because he or busy chasing tv cameras on a new case. Sometimes, its best not to use the lawyer who defended you because he could be a witness. I handle malicious prosecution cases so please feel free to contact me.
