Legal Question in Criminal Law in New York

conspiracy charge

this person was caught with marijuana and he has already did time for it 2 years ago but they came in and arrested him last week. now they want to charge him with conspiracy. the cops said it was an on going investigation for 2 years. he has not done it since he was arrested 2 years ago. they let him go but the other 4 people they arrested had to get bailed out.so i was wondering what this person could get if charged with conspiracy?

He may be charged with conspiracy depending on several facts, overall however if the charge is based on the same crime then there generally can not be any new arrest based on this information... The sentence he served would have already covered this issue.
